Fluxzy Desktop Terms of Use

Please read these Terms of Use ("Terms") carefully before using Fluxzy Desktop ("the Software"). These Terms govern your use of the Software provided by Fluxzy SAS. By using the Software, you agree to be bound by these Terms. If you do not agree with any of these Terms, please refrain from using the Software.

1. License and User Authentication

a. Fluxzy Desktop is proprietary software developed by Fluxzy SAS. Fluxzy SAS grants you a personal, non-transferable, and non-exclusive license to use the Software, subject to your compliance with these Terms.

b. In order to use Fluxzy Desktop, you must create an account and authenticate. The Software is free to use for individuals by means of slight modification at the discretion of Fluxzy Teams.

2. Usage Restrictions

a. You shall not distribute, sublicense, sell, or modify the Software or any part of it without prior written consent from Fluxzy SAS.

b. You shall not reverse engineer, decompile, or disassemble the Software or attempt to derive its source code.

c. You shall not remove or alter any copyright notices or proprietary information from the Software.

3. User Obligations

a. You agree to provide accurate and up-to-date information during the account creation and authentication process.

b. You are solely responsible for maintaining the confidentiality and security of your account credentials. Any activity that occurs under your account is your responsibility.

c. If you use Fluxzy Desktop on behalf of an organization making 1M+ in revenue, you must purchase a professional or enterprise license.

4. Support and Updates

a. Fluxzy SAS may provide support and updates for Fluxzy Desktop at its discretion. The availability and nature of support may vary.

b. Updates may include bug fixes, enhancements, or additional features. It is recommended to keep the Software up to date to ensure optimal performance.

5. Privacy and Data Collection

a. Fluxzy SAS respects your privacy and handles your personal data in accordance with applicable privacy laws and its Privacy Policy. By using Fluxzy Desktop, you consent to the collection, use, and disclosure of your personal data as described in the Privacy Policy.

6. Disclaimer of Warranty

a. The Software is provided "as is" without any warranty of any kind, either expressed or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement.

b. Fluxzy SAS does not warrant that the Software will be error-free or uninterrupted, or that any defects will be corrected.

7. Limitation of Liability

In no event shall Fluxzy SAS be liable for any direct, indirect, incidental, special, exemplary, or consequential damages arising out of the use or inability to use the Software, even if advised of the possibility of such damages.

8. Termination

Fluxzy SAS reserves the right to suspend, terminate, or restrict your access to Fluxzy Desktop at any time and for any reason, without prior notice or liability.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of laws principles.

10. Modifications

Fluxzy SAS reserves the right to modify or replace these Terms at any time. Any changes will be effective immediately upon posting the revised Terms.
